JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-02-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 147, 148, 149, 379, 307, 354, 504 and 506 of the Indian Penal Code.

The prosecution case is that the FIR named accused variously armed entered into the house of the informant took away clothes, cash Rs. 5000/- and ornaments. When the son of the informant namely Talewar Mandal made protest then the co-accused Kalicharan Mandal assaulted on his head with iron rod. It is alleged that the daughter-in-law namely Lachiya Devi came to rescue then she was assaulted by the petitioner with the butt of the country made pistol and snatched her gold chain. When the informant went to rescue then coaccused Sakhichand Mandal assaulted him on his head. It is submitted by the learned counsel for the petitioner that

Patna High Court Cr.Misc. No.4312 of 2016 (2) dt.01-02-2016 2/2 petitioner is agnate of the informant. Runnisaidpur P.S. Case No. 491 of 2015 was lodged by the petitioner's side at earlier point of time. The daughter-in-law of the informant has received injuries by hard and blunt substance but the opinion with regard to nature of injury has been kept reserved. Statement has been made in paragraph-3 of the petition that the petitioner has got no criminal antecedent. It is further submitted that on the background of land dispute the accusation has been made.

Considering the nature of accusation and relationship between the petitioner and the informant coupled with the fact that petitioner's side lodged case against informant at earlier point of time and the petitioner being a lady, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of 12 weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No.

(2) of the Cr.P.C.
