JUSTICE GOPAL PRASAD ORAL ORDER 21-01-2015 Heard learned counsel for the petitioner and learned counsel for the State.

This is a petition for grant of anticipatory bail in a case under Sections 498A, 406, 494 and 120B of the Indian Penal Code as well as Section 4 Dowry Prohibition Act. There is allegation of demand of dowry and on non-fulfilment of the same, subjecting cruelty. Learned counsel for the petitioner submits that the petitioner is ready to keep the complainant with due dignity and honour.

Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on provisional anticipatory bail for four weeks in the event of his arrest or surrender within a period of four

Patna High Court Cr.Misc. No.31420 of 2014 (2) dt.21-01-2015 weeks from the date of receipt/production of a copy of this order on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bikramganj, Rohtas in connection with Complaint Case No. 196 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr. P. C. The Court concerned shall call the victimwife/complainant and if she is ready to live with the husbandpetitioner and petitioner keeps her with due dignity and honour then after four months on being satisfied that both are living together, the trial court shall confirm the provisional anticipatory bail.

If the victim-wife/complainant for any reason does not become ready to live with the petitioner and files petition for right of residence against the husbandpetitioner, the petitioner shall pay maintenance worth Rs.1,200/- per month till a higher maintenance is fixed and the trial Court on being satisfied that the maintenance is being paid shall confirm the bail bond after four months.
