2. This application for anticipatory bail arises out of Natwar P.S. Case No. 216 of 2024 for the offence punishable under Sections 189(2), 127(1), 115(2), 118(1), 117(2), 109, 303(2), 352 of B.N.S.

3. As per the allegation, a panchayati was convened between the parties out of land dispute and the allegation is that 21 accused persons including the petitioner came with weapons with a common intention and started assaulting the family members of the informant. It has further been alleged that coaccused Vijay Giri and Narayan Giri assaulted on head of the informant by means of Garassa and iron rod resulting into serious injuries. It has further been alleged that other accused

It has further been alleged that Rohit Giri took gold chain from Rajkumar Giri, while this petitioner took cash amount, which was lying with Awadh Giri, while Suraj Giri snatched mobile phone of Chanchal Giri.

Learned counsel for the petitioner has submitted that there is a general and omnibus allegation against the petitioner and the specific allegation, if any, is against the co-accused Vijay Giri and Narayan Giri. It has further been submitted that the allegation with respect to snatching of cash amount against the petitioner and Awad Giri is ornamental in nature. It has further been submitted that, admittedly, there is a land dispute between the parties when there is partition between the parties through registered partition. Lastly, it has been submitted that the petitioner was earlier made accused in one another case and he is on bail in that case.

5. Learned counsel for the State opposed the prayer of anticipatory bail of the petitioner.

7. Considering the facts and circumstances, let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on

No.50217 of 2026(2) dt.29-07-2026 3/3 bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bikramganj, Rohtas, in connection with Natwar P.S. Case No. 216 of 2024, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita.
