Petitioner seeks regular bail in a case registered for the offence punishable under Section 326(a), 379 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, this petitioner is alleged to have tried to catch hold of the informant from back side. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. There is no allegation of any overt act against this petitioner. It is submitted that petitioner and informant are cousin as well as own Pattidar and there is land dispute between them and a process u/s 107 of the Cr. P. C. has already been
Patna High Court CR. MISC. No.59543 of 2021(2) dt.10-02-2022 2/2 issued against both parties. Petitioner claims clean antecedent and is in custody since 29.07.2021 and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IX, Vaishali at Hajipur in connection with Jurawanpur PS case No. 65/2019.
