JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-12-2015 Petitioner is languishing in custody since 09.09.2015 in a case registered for the offences punishable under Sections 20/22 of the N.D.P.S. Act.

The prosecution case is that while the police was conducting the vehicle check, one motorcyclist escaped from the scene leaving the motorcycle when on search 1⁄2 kg ganja was recovered from the dickey of the motorcycle. Subsequently from the betel shop of the petitioner, 1⁄2 kg ganja was also recovered.

It is submitted by learned counsel for the petitioner that actually the recovery has not been made from the shop. Though the petitioner is accused in one other case under N.D.P.S Act.

Considering the small quantity of recovery from the petitioner, let the petitioner, above named, be released

Patna High Court Cr.Misc. No.52553 of 2015 (3) dt.08-12-2015 2/2 on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, Darbhanga in connection with Bahera P.S. Case No. 453 of 2015, G.O. Case No. 14 of 2015.

Learned Court below will cancel the bail bonds of the petitioner, if the petitioner defaults for two consecutive occasions or gets involved in similar nature of offence.
