Petitioner seeks bail in Jiyapokhar P.S. Case No.08 of 2019 instituted for the offence under Section(s) 379/34 Indian Penal Code, Section 4(B) of the Bihar Prevention & Improvement of Animal Act, 1955, Section 11(a) (d) of Prevention of Cruelty of Animal Act.

Counsel for the petitioner submits that mere suspicion has been raised against the petitioner in the written report. It is alleged that the informant got information that some cattle are being carried from Nepal to India. The informant reached the place of occurrence and saw five cattle tied together were carried. Petitioner was arrested. The other accused persons managed to flee away.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Kishanganj, in connection with Jiyapokhar P.S. Case No.08 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
