The petitioner seeks pre-arrest bail in connection with Complaint Case No.1398C of 2013 in which cognizance has been taken under Section 420 of the Indian Penal Code. Regard being had to the allegations made in the complaint that the petitioner entered into an agreement with the complainant Smt. Veena Sinha and took rupees six lacks as advance for sale of a piece of plot which was already acquired by the government for construction of Bihta Sermera highway and compensation for which was also paid by the government to the
Patna High Court Cr.Misc. No.2636 of 2016 (3) dt.18-04-2016 2/2 land owner, I am not inclined to grant anticipatory bail to the petitioner.
Accordingly, the application is rejected.
In case the petitioner surrenders and seeks bail, the same shall be considered on its own merits without being prejudiced in any manner by this order.
