====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 15-12-2021 The learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Section 414 of the Indian Penal Code, registered in connection with Marhowrah P.S. Case No.593 of 2020.

As per the allegation made in the FIR the police party raided the house of co-accused Hasrat Ali, wherefrom a motorcycle was recovered and one boy, who was cleaning the motorcycle, tried to flee away, but he was apprehended after a little chase. He could not produce any paper in relation to the motorcycle. Later on, he disclosed that the said motor-cycle was stolen property and it was given by the petitioner and co-

The learned counsel for the petitioner has submitted that there is nothing against the petitioner, except the confessional statement of co-accused. It has also been mentioned in paragraph no.3 of the bail petition that the petitioner has got clean antecedent.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saran in connection with Marhowrah P.S.Case No. 593 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
