JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-10-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offence punishable under Section 366(A) of the Indian Penal Code.
As per prosecution case, this petitioner who is owner of Mobile No. 7461037282 has kidnapped the daughter of the informant.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the mobile phone in question does not belong to the petitioner and petitioner has no concern with the said mobile number. Petitioner has got clean antecedent.
Learned counsel for the State opposes the prayer for
Patna High Court CR. MISC. No.59837 of 2021(3) dt.17-10-2022 2/2 bail application submitting that on the basis of CAF and CDR it is established that mobile number 7461037282 belongs to the petitioner and victim is still traceless.
Considering the aforesaid facts, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
