JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 26-07-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Sadar P.S. Case No. 113 of 2019 (POCSO G.R. No. 14 of 2019) for the offence under Sections 341, 323, 354, 504, 506 of the Indian Penal Code and Section 8 of the POCSO Act.

Allegation against this petitioner is that he was involved in outraging the modesty of the daughter of the informant.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 22.04.2019. He further submits that due to previous enmity the petitioner has been made accused in the instant case on behalf of petitioner's mother a complaint case was filed

Patna High Court CR. MISC. No.46546 of 2019(2) dt.26-07-2019 2/2 against the informant's side on 27.03.2019 and as counter blast, thereafter the petitioner has been made accused in the instant case.

Considering the fact that the petitioner has got no criminal antecedent and there is case and counter case and mother of the petitioner has filed complaint case against the informant's side, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge-cum-Special Judge, POCSO Act, Darbhanga in connection with Sadar P.S. Case No. 113 of 2019 (POCSO G.R. No. 14 of 2019).
