JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-01-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code.
The prosecution case is of abducting the minor daughter of the informant. In 164 Cr.P.C. statement the victim got her age recorded as 18 years when the court also assessed as such. During medical examination the victim was found 17 1⁄2 to 18 years of age.
The victim in 164 Cr.P.C. statement stated that she of her own went out of the hosue in the company of co accused Guddu and has performed marriage with him and she wants to stay
Patna High Court Cr.Misc. No.3696 of 2016 (2) dt.25-01-2016 2/2 with Guddu. The victim has not named the petitioners and the petitioners happen to be the parents of Guddu. Considering the 164 Cr.P.C. statement of the victim, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, East Champaran at Motihari in connection with Turkaulia (Banjaria) P.S. Case No. 232 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
