JUSTICE SUDHIR SINGH ORAL ORDER 13-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 393 of the Indian Penal Code.

Allegation against the petitioner is that he along with other accused persons attempted to snatch belongings of the informant but could not succeed as police party reached there and apprehended three miscreants including petitioner. It has been submitted on behalf of the petitioner that he is in custody since 17.12.2014. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. It has been submitted that there is no recovery of any incriminating articles from the possession of the petitioner. Merely on the basis of suspicion he has been made accused in the present case.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

No.39934 of 2015 (3) dt.13-10-2015 2 / 2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger, in connection with Jamalpur P.S. Case no. 180 of 2014 (G.R. no. 2592 of 2014).
