JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-03-2018 The learned counsel for the petitioners submits that a sum of Rs. 10 lacs and 8 lacs respectively of the petitioner no. 1 and petitioner no. 2 have been illegally withdrawn from their G.P.F. account.

Patna High Court CWJC No.1859 of 2017 (2) dt.21-03-2018 2/2 The respondents have filed a counter affidavit and submits that the present case is squarely covered by a judgment date 31.03.2016 passed in CWJC no. 17659 of 2015, wherein the Principal Secretary, Department of Health has been directed to credit back the amount of G.P.F. illegally withdrawn from the account of the petitioners. It is further submitted that in view of the aforesaid judgment of this Court dated 31.03.2016, many similarly situated employees have been granted all the benefits of G.P.F. illegally withdrawn from their account. Accordingly, I direct the Principal Secretary, Department of Health to credit a sum of Rs. 10 lacs and 8 lacs; the illegally withdrawn G.P.F. amount, into the account of the petitioners no. 1 and 2 respectively within a period of four weeks from today.

The writ petition is disposed of on the aforesaid terms.
