The petitioner apprehends his arrest in connection with Sakra P.S. Case No. 201 of 2020 registered under Sections 272, 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. On perusal of seizure list, it would appear that nothing has been recovered from the possession of the petitioner. The alleged recovery of foreign liquor has been made from the vacant land of Mintu Singh. Further he submits that petitioner has no criminal antecedent. Case No. 201 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
