The petitioner seeks bail in connection with Khaira P.S. Case No. 334 of 2020 instituted for the offences under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 04.08.2021, charge-sheet has been submitted in the case and has antecedent of one case. Learned counsel for the petitioner submits that the informant alleges that seven criminals looted Rs. 5,000/- along with motorcycle of the informant.

Learned counsel for the petitioner submits that the F.I.R. was against unknown and the name of this petitioner transpired in the confessional statement of Pappu Kumar and

Patna High Court CR. MISC. No.59564 of 2021(2) dt.10-03-2022 2/2 Sonu Kumar Yadav who have been granted bail vide order dated 15.11.2021 passed in Cr. Misc. No. 22129 of 2021 (Pappu Kumar) and vide order dated 16.07.2021 passed in Cr. Misc. No. 21990 of 2021 (Sonu Kumar Yadav).

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted and the co-accused on whose confessional statement name of the petitioner transpired have been granted bail, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Khaira P.S.
