JUSTICE JYOTI SARAN ORAL ORDER 30-03-2016 Heard Mr. Baxi S.R.P. Sinha, learned Senior Counsel appearing for the petitioner and learned counsel for the State. The petitioner apprehends his arrest in connection with Piro P.S. Case No.397 of 2015 for offences punishable under sections 306/304(B) of the Indian Penal Code. Mr. Sinha, learned counsel appearing for the petitioner with reference to the FIR present at Annexure-1 submits that there is no dispute that the deceased was staying with her uncle and has consumed poison on her own choice. He submits that the petitioner was also not present at the place of occurrence. He further submits that in the nature of the allegations present, no case under section 304(B) is made out.

Having heard learned counsel for the parties and considering the nature of allegations set out, let the petitioner in

Patna High Court Cr.Misc. No.5134 of 2016 (2) dt.30-03-2016 2/2 the event of his arrest/surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with P.S. Case No. 397 of 2015 subject to the conditions as laid down under section438(2) of the Code of Criminal Procedure.
