JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-07-2019 This application, for grant of anticipatory bail, arises out of Chhatauni P.S. Case No. 156 of 2019, disclosing offences under Sections 406 and 420 of the Indian Penal Code and Section 138 of the N.I. Act.

Allegation is that the petitioner took a friendly loan from the informant of Rs. Four Lakhs Fifty Thousand with assurance to return the same within six months but he did not return the money and when the informant demanded his money, the petitioner issued a cheque of Rs. Four Lakhs Fifty Thousand, which was dishonored by the bank on presentation. Submission of learned counsel for the petitioner is that in fact there was agreement between the parties for execution of sale deed, on which, the petitioner had given blank

No.45963 of 2019(2) dt.25-07-2019 2/2 cheque but later on the petitioner came to know that the land in question does not belong to the petitioner and demanded his cheque, for which, the petitioner has lodged a case against the informant being Pakaridayal P.S. Case No. 90 of 2019. Thereafter, this present false case has been filed by the informant.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Chhatauni P.S. Case No. 156 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
