JUSTICE RAVI RANJAN ORAL ORDER 10-11-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offence punishable under Sections 448 and 354 of the Indian Penal Code. As per the allegation in the First Information Report, the petitioner has entered in the house of the informant at 9.00 P.M. in the night and tried to outrage her modesty and on alarm being raised, he fled away.

It is submitted that there is case and counter case. An FIR has also been lodged by the petitioner stating that he was a Rojgar Sewak and there was pressure from the family of the informant for allotment of fund for construction of house under Indira Awas Yojna as well as for B.P.L. coupon which the petitioner could not meet, thereafter, he was assaulted and a false case was registered.

It is further submitted that the petitioner has already lost his contractual job and has remained in custody since 22.08.2015 having no criminal antecedent. Considering the facts and circumstances of the case, the petitioner, namely, Ajay Kumar is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Arwal in connection with Parasi P.S.
