IN THE HIGH COURT OF JUDICATURE AT PATNA

Civil Writ Jurisdiction Case No.18703 of 2017 ====================================================== Madhusudan Paswan ... ... Petitioner/s

Versus

The State Of Bihar and Ors ... ... Respondent/s ====================================================== Appearance :

For the Petitioner/s :

Mr. Vijay Anand, Advocate Mr. Satyendra Krishna Prasad, Advocate For the Respondent/s :

Mr. Alok Ranjan, AC to AAG 5 ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR and HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER (Per: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR) 16-11-2022 Heard Mr. Vijay Anand, learned Advocate for the petitioner and Mr. Alok Ranjan for the State. The license of the petitioner was cancelled for his having become accused in a criminal case involving breach of Essential Commodities Act, 1955.

It appears from the records that notice was served upon the petitioner to which he replied also. However, on the explanation of the petitioner not having been found to be satisfactory, the license was cancelled. The petitioner had challenged the aforesaid

Patna High Court CWJC No.18703 of 2017(4) dt.16-11-2022 2/2 order in appeal but only after a considerable delay. The appellate court did not accept the grounds raised on behalf of the petitioner for condoning the delay.

The learned counsel for the petitioner could not explain to us the reasons for delayed filing of appeal. In that circumstance, we find enough justification for the appellate court to have declined to entertain the appeal.

There is no merit in this writ petition and the same is dismissed.
