JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 353 and 504 of the Indian Penal Code.
The prosecution case is that the petitioner abused the informant being the Junior Engineer, Electricity Supply Division, Dumra while he was working in the office of Executive Engineer. It is submitted by learned counsel for the petitioner that due to some protest being made for disruption in the electricity supply, the accusation has been levelled. For the occurrence of 04.06.2015 at 4.30 PM, the FIR was lodged on 05.06.2015 at 11.45 AM. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Case No. 419 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
