The present application is being filed by learned counsel for the petitioner for restoration of Cr. Misc. No. 56469 of 2018 to its original position, which was dismissed for default due to non-appearance of learned counsel for the petitioner vide order dated 11.08.2022 passed by this Hon'ble Court. Learned counsel for the petitioner submitted that due to an inadvertent error on the part of the Advocate Clerk in the Chambers, the said was missed out while preparing the Daily Cause List of cases and therefore in the said scenario the issue of non-appearance arose. It is also submitted that the interest of petitioner should not suffer due to the mistake of the counsel and his Chambers.
