05. 13.07.2016 Heard learned counsel for the Petitioner and the State. The Petitioner seeks bail in Tekari P.S. Case No. 181 of 2003 (Tr. No. 15/2014/48/2014) registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act pending before the Additional Sessions Judge-II, Gaya. Considering that now all the witnesses have been examined, this application appears to have become infructuous. The same is dismissed as such.
The Trial Court is directed to expedite the trial and conclude the same positively within a period of one month from the date of receipt of this order without granting unnecessary adjournment to any party.
However, this Court clarifies that even if the trial is not concluded within one month it would not entitle the Petitioner to grant of bail.
