JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-04-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 366-A/34 of the Indian Penal Code.

Petitioner is languishing in jail custody since 22.09.2015 and earlier his prayer for bail was twice rejected by this court. However, while rejecting the prayer for bail of the petitioner vide order dated 20.09.2017 passed in Cr. Misc. No. 42108 of 2017 this court directed the trial court to conclude the trial of the petitioner within four months but the impugned order dated 17.02.2018 goes to show that up till now only four prosecution witnesses could be examined and the trial of the

Patna High Court Cr.Misc. No.20737 of 2018 (2) dt.11-04-2018 2/2 petitioner is still pending.

Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Sitamarhi in connection with Sessions Trial No. 275 of 2016 arising out of Majorganj P.S.
