The petitioner is languishing in jail since 11.05.2015 in a case instituted under Sections 379, 411, 413 and 414/34 of the Indian Penal Code and Sections 25(1-B)a and 26 of the Arms Act. As per allegation, it is a case of recovery of some arms and ammunition and also theft of a motorcycle by the accused persons.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.05.2015. Chargesheet has been submitted in the case. Petitioner has got no criminal antecedent. There is no allegation of tampering of evidence against the petitioner. As per the prosecution case, one country made pistol is
Patna High Court Cr.Misc. No.40208 of 2015 (3) dt.13-10-2015 said to have been recovered from the possession of the petitioner. It is further submitted that the petitioner may be released after completion of six months from 11.05.2015.
Considering the aforesaid facts and circumstances, it is directed that the petitioner be released after completion of six months in custody from 11.05.2015 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction Shri Rakesh Kumar Pandey, Judicial Magistrate, Ist Class, Gaya in connection with Neemchak Bathani P.S.Case No.74 of 2015.
