The petitioner seeks bail in connection with a case registered for the offence punishable u/s 363, 366A of the IPC. 3.

F.I.R. is based upon the allegation of enticing away the daughter of the informant, who went missing on 12.06.2023, by the F.I.R. named accused persons.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He is not named in the F.I.R. and has been falsely implicated in this case due to ulterior motive. No such occurrence, in the manner as alleged, has ever taken place. The statement of the victim was recorded u/s 164 Cr.P.C., in which, she disclosed the name of petitioner and on that basis petitioner has been made accused in

Patna High Court CR. MISC. No.52838 of 2024(2) dt.09-08-2024 2/2 this case. The allegation leveled against the petitioner is not specific rather general and omnibus in nature. At best, merely on the basis that petitioner is the friend of the main accused Karan Mandal, his name has been taken by the victim. Petitioner has no criminal antecedent and he is in custody since 27.05.2024. 5.

Learned APP for the State opposed the prayer for bail. 6.

Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/Successor Court in connection with Banmankhi P.S. Case No.274/2023.
