The petitioner apprehends his arrest in connection with C2A No. 79 of 2021 registered under Section 30(a) and 41(i)(ii) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further he submits that from perusal of the seizure list, it appears that the recovery has been made from the orchard. Petitioner has no concern with the alleged recovery. It is also submitted that petitioner has no criminal antecedent.

Having considered the facts and circumstances of the

No.60014 of 2021(2) dt.15-04-2022 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Additional Sessions Judge-IIcum-Special Judge, Vaishali at Hajipur in connection with C2A No. 79 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
