1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Magadh Medical College P.S. Case no. 455 of 2023 registered under sections 420, 414, 467, 468, 471 and 34 of the Indian Penal Code.

3. As per the prosecution case, the informant states that one Pintu Kumar was caught with a motorcycle and on being asked, he could not produce any document with respect to the same. It is further submitted that the said Pintu Kumar disclosed that he had purchased the stolen motorcycle from the petitioner herein.

4. Learned counsel for the petitioner submits that from the contents of the F.I.R. itself it is evident that no incriminating article has been recovered from the petitioner's

Patna High Court CR. MISC. No.52162 of 2024(2) dt.19-07-2024 2/2 possession. The only material against this petitioner is the statement of co-accused made before police. The petitioner is in custody since 18.1.2024 and charge-sheet has been submitted in the case.

5. The application for bail is opposed by learned A.P.P. for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., his having remained in custody for 6 months since 18.1.2024 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Magadh Medical College P.S. Case no. 455 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Gaya.
