====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 23-12-2022 Heard Mr. Shailesh Kumar, learned counsel for the petitioner and Mr. Dinesh Singh, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Barachatti (Mohanpur) P.S. Case No. 596 of 2021 registered for the offences punishable under Sections 302 and 120-B of the Indian Penal Code 1860.

As per the First Information Report, the marriage of the daughter of the informant namely, Gudiya Devi was solemnized with the son of the petitioner about eight years back. It has been alleged that the petitioner along with other

Patna High Court CR. MISC. No.49238 of 2022(2) dt.23-12-2022 2/3 family members named in the FIR, committed murder of Gudiya Devi by pressing her neck.

Learned counsel for the petitioner submits that the petitioner is mother-in-law of the deceased and her son and daughter-in-law were living separately. He further submits that husband of the petitioner namely, Tilesar Paswan @ Tileshwar Paswan has been granted bail by a co-ordinate Bench of this Court vide order dated 09.12.2022 passed in Cr. Misc. 48846 of 2022. Petitioner is in custody since 14.3.2022.

Regards being had to the submission made by the parties and taking into consideration the fact that the petitioner is the mother-in-law of the deceased, she is in custody since 14.3.2022 and other co-accused has been granted bail by a co-ordinate Bench of this Court, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Barachatti (Mohanpur)
