The petitioner seeks pre-arrest bail in connection with Bakhtiyarpur P.S. Case No. 169 of 2015 registered under Sections 302 read with 34 of the Indian Penal Code and Section 27 of the Arms Act.

Regard being had to the gravity of the offence as also the fact that the deceased Santosh Yadav disclosed before his death to his wife in presence of two independent witnesses, namely, Dani Yadav and Ghanshyam Yadav that the petitioner was one of the accused involved in firing upon him, I am not
