The petitioner seeks bail in a case registered under Sections 498A, 323, 365, 504, 506/34 of the Indian Penal Code. Allegation is that the accused persons including the petitioner assaulted and tortured mentally to the sister of the informant. The informant has raised suspicion that the in-laws people might have committed some untowards incident. It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.2.2018 has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is the father-in-law of the victim. He is separate in mess and property from the
Patna High Court Cr.Misc. No.20193 of 2018(2) dt.12-04-2018 2/2 husband of the victim. The victim had gone to her Naihar and thereafter she is traceless. The present prosecution is a malicious prosecution. The victim was mentally ill and was being treated at Mental Hospital, Ranchi.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, East, Muzaffarpur in connection with Mithanpura P.S. case No.34 of 2018.
