Mr.Mukesh Kumar Singh, APP ====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA MISHRA ORAL ORDER 07-08-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is renewing her prayer for anticipatory bail on the ground of her illness. It is relevant to mention here that the anticipatory bail application of the present petitioner was earlier rejected vide order dated 25.11.2016 passed in Cr.Misc. No.25375 of 2016. In the said case, this Court had taken into consideration several paragraphs of the case diary and found materials against the present petitioner and her husband and accordingly rejected the prayer for their pre-arrest bail. In view of the fact that no second anticipatory bail application is maintainable and also because the medical certificate does not inspire confidence, I am not inclined to accept the prayer for anticipatory bail. It is, accordingly, declined.
Patna High Court CR. MISC. No.46861 of 2019(2) dt.07-08-2019 2/2 However, if the petitioner appears in the court below within a period of four weeks from today, it shall be open to the concerned court to consider her prayer for bail on its own merits without being prejudiced by this order.
