2. The petitioner seeks regular bail in connection with Kateya P.S. Case No.144 of 2025 lodged under Sections 317(5) & 111 of the BNS, 2023 read with Section 30 of the Bihar Prohibition and Excise Amendment Act, 2022.
3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 05.06.2025 passed in Cr. Misc. No.34948 of 2025 with liberty that he may renew his prayer for bail after framing of charge.
4. Learned counsel for the petitioner further submits that the petitioner's antecedent is clean and he is in custody
Patna High Court CR. MISC. No.48372 of 2025(3) dt.12-09-2025 2/2 since 18.03.2025. He further submits that charge has been framed on 05.06.2025 and progress report of the trial has been called for.
5. Learned APP for the State opposes the prayer for bail and submits that the recovery of 621 illicit liquor has been subject matter of the present case and petitioner is a driver. He further submits that charge has already been framed in this case.
6. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail, subject to payment of Rs.5,000/- in the Prime Minister National Relief Fund, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) as mentioned in Section 2(1) (d) of the BNSS, 2023 to the satisfaction of Addl. District & Sessions Judge-XIII -cum-Special Judge Excise Court No.1, Gopalganj in connection with Kateya P.S. Case No.144 of 2025, subject to the following conditions as laid down under Section 480(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
