JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 14-10-2015 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner seeks bail in connection with Jhajha P.S. Case No. 10 of 2015 registered for the offences punishable under Sections 366A of the Indian Penal Code.

Allegedly, Chandan Chaudhary told the informant that his daughter Tara Kumari has been taken away by Aftab Ansari and the petitioner on motorcycle bearing Regd. No. JH11H-9460. During investigation the victim girl has been recovered and in her statement recorded under Section 164 Cr.P.C., she has not named the petitioner and has stated that Aftab Ansari has committed rape with her.

Submission is of false implication and that the

Patna High Court Cr.Misc. No.27600 of 2015 (3) dt.14-10-2015 petitioner is in suffering in custody since 17.01.2015. Learned APP submits that petitioner was caught with motorcycle which was used in the crime and motorcycle belongs to the petitioner.

In the facts and circumstances stated above, considering that the petitioner has not committed rape and further considering the period of detention, the petitioner named above is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Additional Sessions Judge in POCSO Case No. 06 of 2015 arising out of Jhajha P.S. Case No. 10 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
