JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The victim has already been recovered and her statement was recorded under section 164 of the Cr.P.C. In the aforesaid statement victim stated that she was taken away by the petitioner but petitioner did not misbehave with her and even did not touch her body.

The contention on behalf of the petitioner is that the application of section 366A of the Indian Penal Code is doubtful and so far as section 363 of the Indian Penal Code is concerned, the same is bailable.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,

Patna High Court Cr.Misc. No.30940 of 2015 (3) dt.14-10-2015 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sheikhpura in connection with Sheikhpura (O.P. Kusumbha) P.S.Case No. 90 of 2015.
