This application is for grant of regular bail in connection with Arwal P.S. Case No. 336 of 2018 for the offences under Sections 420, 467, 468, 471 and 34 of the Indian Penal Code.

Allegation against the petitioner is that he opened his account in the Bank of India, Gidhlaur branch, Vishakhapattnam and in between the period of 25.10.2018 and 04.12.2018 transaction of Rs. 23 lacs has been made and later on complaint was received from the Bank of India, Gidhlaur, branch, Vishakhapattnam about the cheating of Rs. 15,500. Later on the matter was withdrawn and his account was stopped. Submission of the learned counsel for the petitioner is that during investigation it confirmed that account was opened

Patna High Court CR. MISC. No.50097 of 2019(6) dt.02-03-2020 2/2 in the name of the petitioner on the assurance of giving Rs. 2000/- per transaction and the same was operated by other accused persons. He is in custody since 06.12.2018 and he has nothing to do with the transaction.

Heard learned APP opposed the prayer for bail. In view of the submission and considering the facts and circumstances, as stated above, let the petitioner, above named, enlarged on bail on furnishing bail bond of Rs. 25,000/- (twenty Five thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal in connection with Arwal P.S. Case No. 336 of 2018, subject to condition that he has to appear before the court below his address as well as address of the bailors must be verified and with further condition that he has to appear before the trial court when required, otherwise his bail bonds shall be cancelled. Accordingly, this application is allowed.
