The petitioner seeks bail in a case instituted for the offences under Sections 37(b) of the Bihar Prohibition and Excise Act, 2016.

Prosecution case, in short, is that the petitioner was found in drunken condition at Super market.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 10.01.2018. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is alleged to be found in drunken state. He has been made accused due to mistake of fact. There is no recovery of any liquor from his possession.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Saharsa in connection with Special (Excise) case No.18 of 2018.
