The petitioner seeks bail in a case registered for the offences punishable under sections 384 and 386 of the Indian Penal Code.

It is alleged that on 28.06.2015 a demand of Rangdari of Rs.20 lacs was made by the accused on the mobile of the informant and also threatening was given to kill him. Thereafter again on 02.07.2015 a demand of Rs. Five lacs was made and threatening was given to the kill the family members of the informant.

It has been submitted on behalf of the petitioner

Patna High Court Cr.Misc. No.41513 of 2015 (3) dt.14-10-2015 that petitioner is in custody since 10.07.2015. Charge-sheet has been submitted in the case. Petitioner has got no criminal antecedent. There is no allegation of tampering with the evidence against the petitioner. Petitioner has falsely been implicated in the present case due to mistake of fact. It has further been submitted that the petitioner may be enlarged on bail after completion of six months in custody from 10.07.2015.

On behalf of the State, it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on completion of six months in custody from 10.07.2015 on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Bettiah Town P.S. Case No. 434 of 2015.
