JUSTICE ARUN KUMAR ORAL ORDER 21-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Special Case No. 15 of 2017 arising out of Khagaria P.S.Case No. 709 of 2017 registered under Sections 8,20(b)(ii)B of Narcotic Drugs and Psychotropic Substance Act. Allegation in brief is that 4.5 Kg ganja was recovered from the bag pack of the motorcycle of the petitioner. Submission is that so-called seizure is only 4.5 Kg and petitioner was apprehended merely on suspicion and he has also no any criminal antecedent.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Gautam Kumar @ Manjay Kumar, is directed to be released on bail after framing of charge upon furnishing bail bond of Rs. 10,000/- with two sureties of the

Patna High Court Cr.Misc. No.9566 of 2018 (3) dt.21-02-2018 2/2 like amount each in connection with Special Case No. 15 of 2017 arising out of Khagaria P.S.Case No. 709 of 2017 to the satisfaction of the court below.
