The petitioner is in custody in connection with Sessions Trial No.359 of 2018 arising out of Pawana P.S.Case No.56 of 2017 pending in the Court of Additional Sessions Judge-III, Bhojpur at Ara registered for an offence under Sections 304(B)/34 of the Indian Penal Code.

As per prosecution case, due to non-fulfilment of demand of dowry, the deceased was tortured who ultimately died at the hands of petitioner.

From perusal of the impugned order, it appears that there is direct allegation against the petitioner (husband) who caused murder of the deceased due to non-fulfilment of the

Patna High Court CR. MISC. No.47053 of 2019(4) dt.24-10-2019 2/2 dowry.

In view of the aforesaid facts, I am not inclined to grant bail to the petitioner. Prayer for bail of the petitioner is rejected.

However, the trial Court is directed to conclude the trial within a period of nine months from the date of production/receipt of this order.
