JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-12-2022 Heard learned counsel for the petitioner and the State. The petitioners apprehend their arrest in a case registered for the offence under Sections 354(B), 376, 511/34 of the Indian Penal Code and Section 8 of the POCSO Act. As per prosecution case, this petitioner is alleged to have attempted to commit rape with niece of the complainant. It is submitted that petitioner has falsely been implicated in this case due to previous case that is Bettiah SC & ST PS case No. 06/22, which is pending against the complainant and his family members. Petitioner has got clean antecedent. Learned A.P.P. for the State has opposed the bail petition.

No.49950 of 2022(3) dt.22-12-2022 2/2 Considering the facts of the case and the fact that petitioner has got clean antecedent, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bailbonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 7th A.D.J. cum Special Judge, POCSO, West Champaran, Bettiah in connection with Complaint Case No. 06 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
