The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 323, 324, 307 and 504 of the Indian Penal Code.
It is alleged that both the petitioners assaulted the informant by means of iron rod. It is also alleged that petitioner no.2 assaulted the cousin brother of the informant. namely, Sunil Singh.
It is submitted by learned counsel for the petitioners that for a petty dispute the accusation has been levelled. Only one injury has been received by the informant which clouds the bona fide of the accusation that both the petitioners assaulted the
Patna High Court Cr.Misc. No.2974 of 2016 (2) dt.25-01-2016 2/2 informant. The injury of the informant has been found to be simple and no injury has been caused to the cousin of the informant. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the accusation being not corroborated with the medical opinion, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Magadh Medical P.S. Case No.137/2015 in connection with learned CJM, Gaya, subject to the conditions as laid down under Section 438(2) Cr.P.C.
