JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-02-2018 Earlier prayer for bail of the petitioner was rejected vide order, dated 13.07.2017, passed in Cr. Misc. No. 31677 of 2017 with liberty to the petitioner if the trial is not concluded within a period of six months.
Submission of the learned counsel for the petitioner is that charge has not be framed in this case, which he has stated on oath in his petition and the petitioner is languishing in jail custody since 18.08.2016.
Heard the learned Additional Public Prosecutor also. In view of the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (rupees twenty-five thousand) with two sureties of the like amount each in connection with Sessions Trial
Patna High Court Cr.Misc. No.7725 of 2018 (2) dt.08-02-2018 2/2 No. 112 of 2017 arising out of G.R.P. Jamalpur P.S. Case No. 42 of 2016 to the satisfaction of the Additional Sessions Judge, I, Lakhisarai, with the conditions that one of the bailors shall be a local resident and the another would be that the petitioner shall cooperate in the trial, otherwise his bail bond shall be cancelled. With the aforesaid observations, this application is disposed of.
