2. This appeal has been filed for setting aside order dated , passed in a case registered for the offence punishable under sections 307/302 and other ancillary sections of the Indian Penal Code, section 27 of the Arms Act and section 3(i)(r) (s)/3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, whereby prayer for anticipatory bail of the appellant has been rejected.
3. As per the prosecution case, accused persons made indiscriminate firing on the informant side in which two persons died due to fire arms injuries. Petitioner along with co-accused Thakurai and Sanny Kumar are alleged to have fired at the
Patna High Court CR. APP (SJ) No.2958 of 2022(26) dt.22-09-2023 2/2 informant and his cousin causing them gun shot injuries.
4. Considering the allegation and the fact that this petitioner along with co-accused person caused multiple fire arms injuries as a result of which two persons died, I do not find any ground to interfere with the impugned order. Accordingly, this appeal, seeking pre-arrest of the appellant, is dismissed. (Prabhat Kumar Singh, J) Shashi U T
