The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and 47a of the Excise Act. From the house of the petitioner country made and foreign liquor were recovered.

It is submitted by learned counsel for the petitioner that petitioner is a mentally abrased person and is being treated at Ranchi. Moreover, the recovery is from the joint family house and maliciously the petitioner has been roped in the present case. None of the family members of the petitioner or any other person have been made accused in the present case. A statement has been made in paragraph 3 of the petition that the petitioner

Patna High Court Cr.Misc. No.4635 of 2016 (2) dt.04-02-2016 2/2 has no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Barh P.S. Case No.420/2015, pending before the learned ACJM, Barh, Patna. With the above observation, this application is, accordingly, disposed off.
