The petitioner seeks bail in Naubatpur P.S. Case No. 378 of 2016 registered for the offence punishable under Sections 302/34 of the Indian Penal Code.
Informant in her fardbeyan has stated that on 28.12.2016 deceased Sharifan Rai went outside to attend the call of nature at 4 O' Clock in the morning and when reached near the school, she heard sound of firing and alarm raised by the deceased and when she went outside she saw that Mukesh Kumar was carrying pistol in his hand and was returning towards the village and behind him petitioner Deo Nandan Yadav and his brother Kirani Yadav was following him. There is land and property dispute between the informant and accused
Patna High Court Cr.Misc. No.6844 of 2018(3) dt.05-03-2018 2/2 and it has been stated that the deceased was issueless and he had gifted all the property to the informant and her family, and on account of such dispute accused have killed her maternal uncle. It has been submitted on behalf of the petitioner that there is no specific allegation against the petitioner of firing on the deceased and only allegation made against him is that he was following the assailant. Petitioner has got no criminal antecedent and is in custody since 07.09.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Danapur n connection with Naubatpur P.S. Case No. 378 of 2016.
