The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 279, 323, 325, 338, 341, 379 of the Indian Penal Code and 3(1)(x) of the SC/ST (Prevention of Atrocities) Act.
It is alleged that the petitioner being the auto rickshaw driver dashed the father of the informant on 08.02.2014. Subsequently, he agreed to make payment for medical treatment of the father of the informant but he did not make any payment when demand of money was made by the informant then he was abused by calling caste name.
It is submitted by learned counsel for the petitioner that for occurrence of 08.02.2014
Patna High Court Cr.Misc. No.33728 of 2014 (2) dt.16-02-2015 2 / 2 complaint was filed on 18.02.2014 and the police was informed on 28.03.2014 which came to be registered as police case on 29.03.2014 and subsequently the informant has retracted from his initial version and filed a petition to that effect before the learned court below.
Considering delayed lodging of the case and retracted version of the informant, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Supaul ST/SC P.S. Case No. 09 of 2014 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Supaul, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
