JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-02-2022 Heard Mr. Shivnandan Bharti, the learned Advocate for the petitioner and Mr. Shivam, the learned counsel for the informant. The State is represented by the learned APP. The petitioner, who is the husband of the informant, seeks bail in anticipation of his arrest in connection with Akbarpur P.S. Case No. 203 of 2018, dated 25.08.2018, instituted for the offences under Sections 341,

Patna High Court CR. MISC. No.5865 of 2021(7) dt.28-02-2022 2/3 323 and 498(A) of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

An agreement had been arrived at between the parties and pursuant to that agreement, the petitioner was required to pay an amount of Rs. 15 lakhs to his wife/informant, in all, towards all her matrimonial dues. Against the aforesaid agreement, Rs. 8 lakhs had already been paid and for some reason, the balance amount of Rs. 7 lakhs could not be paid.

On the last occasion, the counsel for the petitioner had assured this Court that on the next date, he shall bring a draft of Rs. 7 lakhs, payable in the name of his wife/informant.

As promised, the counsel for the petitioner has brought a draft of Rs. 7 lakhs of the Punjab National Bank, payable in the name of Sakshi Kumari (the informant of this case) vide Draft No. 874276.

The aforesaid draft is being handed over to Mr. Shivam, the counsel for the informant, which he accepts for handing it over to the informant.

Patna High Court CR. MISC. No.5865 of 2021(7) dt.28-02-2022 3/3 Considering the afore-noted facts, the provisional bail granted to the petitioner vide order dated 02.11.2021 is directed to be confirmed.
