The petitioner, who is in custody, seeks bail in connection with Banka P.S. Case No. 68 of 2017 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504 of the Indian Penal Code.

Informant is the son of victim who, in his fardbeyan has stated that on 26.01.2017 at about 4:00 PM when his father Gyandeo Mandal was returning from motorcycle from his shop then accused persons Chhote Lal Mandal (petitioner), Raj Kumar Mandal, Anil Kumar Mandal, Sunil Kumar Mandal, Suchit Kumar Mandal and wife of Chhote Lal Mandal all sons of Choote Lal Mandal (petitioner) surrounded him and thereafter

Patna High Court Cr.Misc. No.7356 of 2018(3) dt.28-02-2018 2/2 petitioner gave order to his sons, upon which the Raj Kumar Mandal assaulted on the head of his father and he became unconscious. Allegation against the petitioner is of only order giver and no overt act has been alleged against him. It has been further submitted that co-accused persons, namely Anoda Devi and Sunil Kumar Mandal have already been granted bail by a coordinate Bench of this Court vide order dated 18.10.2017 passed in Cr. Misc. No. 50698 of 2017. Petitioner has no criminal antecedent and he is in custody since 03.01.2018. considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka, in connection with Banka P.S. Case No. 68 of 2017.
