The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 325, 354B, 379, 448, 504 and 506of the Indian Penal Code. The prosecution case as per the written report of Anjani Devi submitted to the Station House Officer of Goradih Police Station is to the effect that the on 16.01.2019 at 5.00 P.M. the informant was at her house when the petitioner came, abused the informant and made assault with danda causing fracture of left wrist of the informant. It is further alleged that the petitioner outraged the modesty of the informant. It is submitted by learned counsel for the petitioner in the background of money dispute, the accusation has been
Patna High Court CR. MISC. No.48095 of 2019(2) dt.01-08-2019 2/2 levelled against the petitioner and a statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.
Learned APP submits that there is specific accusation of assault against the petitioner.
Considering the nature of accusation, it is a case for consideration of prayer for regular bail, if the petitioner surrenders before the learned Court below within a period of six weeks from today in connection with Jagdishpur (Goradih) P.S. Case No. 19 of 2019, pending in the Court of learned Chief Judicial Magistrate, Bhagalpur.
