The petitioner seeks bail in a case registered under Sections 302, 120(B)/34 of the Indian Penal Code and 27 of the Arms Act.

It is submitted on behalf of the petitioner that it would be evident from the first information report that one Laxman Yadav had fired upon the deceased. The informant, who happens to be the widow of the deceased, has given a graphic account of the occurrence in the first information report and has stated that one Laxman Yadav started firing upon her husband and when he saw that he is still alive then he again started firing upon him so that he could be killed. It is contended that two of the co-accused persons, namely, Pappu Yadav, who is on the identical footing to the petitioner and Rameshwari Yadav, have already been granted bail by different Benches of this Court.

Learned counsel for the informant has submitted that, in the further statement of the informant, she has also taken the name of the petitioner and other co-accused Pappu Yadav, of having assaulted her husband, out of them, Pappu Yadav has already been granted bail by this Court vide order dated 18.06.2015 passed in Cr. Misc. No.21514 of 2015. Having regard to the facts and the circumstances of the case, the petitioner, Ajay Yadav is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar Police Station Case No.19/2015.
